Why we ask — and where it goes

The club keeps a roster of current members. It's how we confirm who's eligible to enter competitions, and how we let you know about meetings and field trips. Your details are used for club purposes only — we don't sell them, and we won't share them outside the club without asking you first.

Release & Waiver

Every member agrees to this. It's short, and here's the gist before the formal wording:

  • Club outings are informal. We suggest a time and place — we don't guide, supervise, or drive you there.
  • You decide what you're comfortable attempting, and you can step back from any activity at any time.
  • You agree not to sue the Club or its volunteers over an honest mistake. Serious misconduct is not covered by that.
  • You keep the copyright in your photographs. You're letting us show them, with your name, in Club galleries and publications.

1. Nature of the Club and its Activities

I understand that the Santa Rosa Photographic Society (“the Club”) is a California nonprofit corporation whose purpose is the enjoyment and advancement of photography.

I understand that the Club and its members from time to time suggest dates, times and places to meet for photography — including field trips, photo walks, workshops, competitions and social gatherings (“Activities”). I understand that the Club does not employ guides, does not provide transportation, and does not supervise or lead these Activities. Each participant attends at their own discretion and makes their own arrangements for travel, lodging, equipment and personal safety.

2. Assumption of Risk

I understand that photography Activities may take place outdoors and away from assistance, and may involve risks including uneven or unstable ground, cliffs and coastal bluffs, tides and surf, moving water, weather and temperature extremes, low light and night conditions, wildlife and insects, plants, traffic and roadways, and travel to and from locations.

I am voluntarily participating with knowledge of these risks, and I accept responsibility for my own safety, for assessing my own physical ability to participate, and for deciding whether to attempt any particular location, route or shot. I may decline to participate in any Activity at any time.

3. Release of Liability

In consideration of being permitted to participate, I release the Club, its officers, directors, volunteers and members (acting in their capacity as such) from claims for injury, illness, death, or loss of or damage to property arising out of my participation in Activities or my travel to or from them, to the extent such claims arise from ordinary negligence.

This release does not apply to, and I do not waive claims for, gross negligence, recklessness, willful or intentional misconduct, fraud, or any liability that may not be released under California law. If any part of this release is held unenforceable, the remainder stays in effect.

4. Claims Against Individuals

I understand that Section 3 releases the Club’s officers, directors, volunteers and members — including field trip leaders and anyone else organising or leading a Club Activity — from claims arising from ordinary negligence in connection with Club Activities.

I retain the right to pursue any such person individually for intentional misconduct, recklessness, or gross negligence.

Nothing in this Agreement affects any right I may have against a person who is not acting for the Club — including another driver, a property owner, a venue, or any other third party.

5. Photographs, Name and Submitted Images

(a) Images I submit. When I submit a photograph to a Club competition, gallery, newsletter or website, I grant the Club a non-exclusive, royalty-free licence to display and reproduce that image, together with its title and my name, for Club purposes — including the Club website, social media, newsletter, exhibitions, and entry into N4C or similar inter-club competitions. I keep the copyright in my photographs. I may ask the Club in writing to stop displaying a particular image, and the Club will remove it from Club-controlled media within a reasonable time.

(b) Images of me. I consent to being photographed or recorded at Club Activities, and to the Club using such images to depict Club activities. I may opt out of this at any time by notifying the membership chair in writing, and the Club will not thereafter use new images of me in Club media.

(c) Warranty. I confirm that images I submit are my own original work and that I have obtained any permissions needed from people or property owners depicted, as required by competition rules.

6. Privacy

Information I provide will be used for Club purposes only and will not be sold or shared outside the Club without my permission, except as required by law.

7. Medical

If I am injured during an Activity and cannot direct my own care, I consent to Club members summoning emergency medical assistance. I am responsible for the costs of any medical treatment.

8. Governing Law and Acknowledgement

This Agreement is governed by the laws of the State of California. I have read this Agreement, I understand that I am giving up certain legal rights, and I agree to it voluntarily.
